Abstract: Since the Scheduled Tribes are vulnerable for exploitation and are socially, educationally and economically backward, the Constitution of India provides for both protection and development of these historically backward communities. Article 342(1), President of India made the Constitution (Scheduled Tribes) Order 1950, notifying certain tribes as Scheduled Tribes in respect of each State for the purpose of the Constitution. The list of Scheduled Tribes issued in the Constitution Order, 1950 has been amended during the September 1956 by the Scheduled Caste and Scheduled Tribes Order (Amendment) Act, 1956 wherein 23 Tribes have been notified as Scheduled Tribes through out the State and 3 Tribes in Agency tracts in respect of Andhra State. The provisions under the Fifth Schedule to the Constitution of India empowers the Government to make a law of the Central and State Government inapplicable to any Scheduled Area or any part thereof or to make it applicable with such modifications as he may consider necessary through a notification. The Constitution of India, Article 366 (25) defines Scheduled Tribes as such tribes or tribal communities or parts of or groups within such tribes or tribal communities as are deemed under Article 342 to be Scheduled Tribes for the purposes of this Constitution. Article 342 prescribes the procedure to be followed in a matter of specification of Scheduled Tribes. The advantage of Scheduled Area is prohibiting or restrict transfer of land from Tribals and Regulate the business of money lending to the members of Scheduled Tribes. To give a further thrust to the welfare and development of the Scheduled Tribes, a Scheduled Area and Scheduled Tribes Commission has been set up vide Order dated 18th July, 2002. State wise list of Scheduled Area of Andhra Pradesh in presented in the report. The present report attention on all existing aspects of Amendments, Order, Acts and procedure for inclusion in or exclusion from the list of Scheduled Tribes, Scheduled Tribes Community Certificate Points to be observed, Government Order and Memos, and Court Judgments
